Introduction:
PSI-Japan is operating under the authority of the Internet Corporation for Assigned Names and Numbers (ICANN). We also must comply with rules set out by the Domain Name Registry.
Registrants in domains and the control of ICANN are required to agree to two separate documents, the ICANN Uniform Domain Name Dispute Resolution Policy (UDRP) and this PSI-Japan Registration Agreement (PSI-RA), which is based in part on provisions of the ICANN Registration Accreditation Agreement, hereinafter referred to as "ICANN Agreement". Examples of domains under the control of ICANN are those ending in .com, .net, .org, .info, and .biz.

Registration Agreement:
This Registration Agreement ("Agreement") is between you (as an individual) or your company, association or other enterprise (hereinafter referred to as "Registrant") and PSI-Japan, Inc. (hereinafter referred to as "PSI-Japan"). The Agreement sets forth the terms and conditions to register an Internet domain name through PSI-Japan. To complete the registration process, Registrant must read and agree to be bound by all terms and conditions of this Agreement and the accompanying UDRP, and any rules or policies that are or may be published by Internet Corporation for Assigned Names and Numbers ("ICANN") under the Agreement between PSI-Japan and ICANN ("ICANN Agreement"). Registrant acknowledges that PSI-Japan may modify this Agreement if necessary to comply with its ICANN Agreement.
1. General.
This Agreement, the PSI-Japan fee schedule and the UDRP, together with all amendments or modifications to any of them, constitute the complete and exclusive agreement between Registrant and PSI-Japan , and they supersede and govern all prior proposals, agreements, or other communications.
Nothing contained in this Policy shall be construed as creating any agency, partnership, or other form of joint enterprise between the parties. The failure of PSI-Japan to require Registrant's performance of any provision hereof shall not affect the full right to require such performance at any time thereafter; nor shall the waiver by PSI-Japan of a breach of any provision hereof be taken or held to be a waiver of the provision itself. In the event that any provision of this Agreement shall be unenforceable or invalid under any applicable law or be so held by applicable court decision, such unenforceability or invalidity shall not render this Agreement unenforceable or invalid as a whole. PSI-Japan will amend or replace such provision with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of PSI-Japan as reflected in the original provision. No provision of this Agreement, including the PSI-Japan fee schedule and the UDRP, may not be amended or modified by Registrant except by means of a written document signed by PSI-Japan .
2. Dispute Policy (UDRP).
Registrant agrees to be bound by the current ICANN Uniform Domain Name Dispute Resolution Policy ("UDRP") which is incorporated into this Agreement by reference. The UDRP can be found at
UDRP. Any disputes regarding the right to use Registrant's domain name will be subject to the UDRP. ICANN may modify the UDRP in its sole discretion at any time. Registrant's continued use of Registrant's domain name after modification to the UDRP constitutes Registrant's acceptance of those modifications. If Registrant does not agree to such a modification, Registrant may request that Registrant's domain name be deleted.
Registrant agrees that it will be subject to the provisions specified in the UDRP in effect at the time Registrant's domain name is challenged by a third party. Registrant also agrees that in the event a domain name dispute arises with any third party, Registrant will indemnify and hold PSI-Japan harmless pursuant to the terms and conditions contained in the UDRP.
3. Language for the Resolution Procedure
Notwithstanding any provisions contained in any other rules, etc., the language for the Mandatory Administrative Proceeding described in Paragraph 4 of the UDRP shall be the English language.
4. Use of Registrant's Information.
As part of the registration process, Registrant (you or your company) is required to provide certain information and to update this information to keep it current, complete and accurate. This information includes (i) Registrant's full name, postal address, e-mail address, voice telephone number, and fax number if available; (ii) the name of an authorized person for contact purposes in the case of a registrant that is an organization, association, or corporation; (iii) the IP addresses of the primary nameserver and any secondary nameservers for the domain name; (iv) the corresponding names of those nameservers; (v) the full name, postal address, e-mail address, voice telephone number, and fax number if available of the technical contact for the domain name; (vi) the full name, postal address, e-mail address, voice telephone number, and fax number if available of the administrative contact for the domain name; (vii) the name, postal address, e-mail address, voice telephone number, and fax number if available of the zone contact for the domain name. (See ICANN Agreement, Section II,7,a). PSI-Japan also collects a similar set of contact data for the billing contact for the domain name.
Registrant acknowledges that willfully providing inaccurate information or willfully failing to update information promptly will constitute a material breach of this Agreement and will be a basis for cancellation of Registrant's domain name if Registrant does not respond within 15 days (See ICANN Agreement, Section II,7,a, paragraph 2).
If Registrant licenses use of a domain name to a third party, Registrant is nonetheless the holder of record of the domain name and is responsible for providing Registrant's own full contact information and for providing and updating accurate technical, administrative, and zone contact information. (See ICANN Agreement, Section II,7,a, paragraph 3.)
Registrant acknowledges that PSI-Japan will make some of the information that Registrant provides during the registration process publicly available as required by ICANN. Additionally, Registrant acknowledges that ICANN may impose guidelines, limits and/or requirements that relate to the amount and type of information that PSI-Japan may or must make available to the public or to private entities. PSI-Japan will not otherwise disclose Registrant's information to any third party unless it is required to maintain Registrant's domain name. Registrant may request a copy of Registrant's information in PSI-Japan's possession to review, modify or update such information. (For details, see ICANN Agreement Section II,.J.7.a & b. PSI-Japan only requires those data elements specified in a, and discloses only those elements as required by this section).
Registrant represents that, to the best of your knowledge and belief, neither the registration of your domain nor the manner in which your domain is directly or indirectly used infringes the legal rights of a third party (See ICANN Agreement, Section II,7,g).
5. Agents and Licenses.
Registrant agrees that, if Registrant's domain name is registered on Registrant's behalf by anyone acting as Registrant's agent (e.g., an Internet Service Provider, advertising agency, employee, etc.), Registrant is nonetheless bound as a principal by all terms and conditions provided herein, including the UDRP.
Registrant agrees that if Registrant licenses the use of Registrant's domain name to a third party, Registrant remains the domain name holder, and remains responsible for all obligations under this Agreement. (See ICANN Agreement, Section II.J.7.a paragraph 3: "Any SLD holder that intends to license use of a domain name to a third party is nonetheless the SLD holder of record and is responsible for providing its own full contact information and for providing and updating accurate technical and administrative contact information adequate to facilitate timely resolution of any problems that arise in connection with the SLD. An SLD holder licensing use of an SLD according to this provision shall accept liability for harm caused by wrongful use of the SLD, unless it promptly discloses the identity of the licensee to a party providing the SLD holder reasonable evidence of actionable harm.")
6. Representations and Warranties.
Registrant represents and warrants that all information provided by Registrant in connection with Registrant's registration is complete and accurate. PSI-Japan makes no representation or warranties of any kind in connection with this Agreement. PSI-Japan does not represent or warrant that registration of Registrant's domain name will immunize Registrant from challenges to Registrant's domain name.
7. Use Policies.
In the event that unsolicited commercial advertisements ("spamming") are illegal or against ICANN rules, and you engage in this activity using your domains, PSI-Japan may be required to suspend or cancel the domain name. Similarly, if Registrant uses Registrant's domain name in connection with unlawful activity, PSI-Japan may be required to suspend or cancel the domain name.
8. Breach and Revocation
Any breach by Registrant of this Agreement or the UDRP must be remedied by Registrant within 30 days of notice by PSI-Japan . If Registrant fails to cure the breach, PSI-Japan may revoke Registrant's registration of the domain name.
Registrant also agrees that PSI-Japan shall have the right to revoke, suspend, transfer or otherwise modify a domain name registration upon fifteen (15) calendar days prior written notice; such action being required if PSI-Japan receives a properly authenticated order from a court of competent jurisdiction, arbitration award, or ruling from a panel operating under the UDRP requiring the revocation, suspension, transfer or modification of the domain name registration. (ICANN Agreement Section II.J.7.a paragraph 2.)
9. Fees.
As consideration for the domain name registration services provided by PSI-Japan, Registrant shall pay all applicable initial registration fees and renewal fees. Registrant will be notified when renewal fees are due, and it shall be Registrant's responsibility to ensure that such fees are paid. Should these fees go unpaid by the time specified in the renewal notice, Registrant's registration will be cancelled. Registrant agrees that PSI-Japan shall have no liability whatsoever with respect to any such cancellation.
10. Deletion and Renewal Policy
Domain names are registered for fixed periods that are subject to renewal.
For PSI-Japan's customers using “auto-renew” domain name registration, we will attempt to automatically renew the domain name registration at the day after the domain name registration expiration date.
For customers not using “auto-renew” for a domain name registration, we send several communications to customers and/or the agents acting on their behalf to alert them that their domain name registration services will expire on a certain date.
If a customer does not renew the domain name registration by the expiration date, the domain name registration is subject to deletion at any time after that. In an effort to help our customers avoid unintentional deletion of their domain name registration(s), we may, but are not obligated to, provide our customers with a “grace period” after their domain name registration services expiration date(s) (a “grace period” begins on the day after the date of expiration). We currently endeavor to provide a grace period that extends 40 days past the expiration date, to allow the renewal of domain name registration services. During this period a customer can renew a domain name registration; however, a grace period is not guaranteed and can change or be eliminated at any time without notice. Consequently, every customer who desires to renew his or her domain name registration services should do so in advance of the expiration date to avoid any unintended domain name deletion.
If an expired domain name registration is not renewed during any grace period provided by us, pursuant to our Service Agreement, rather than delete the domain name registration, we may, in our sole discretion, renew and transfer the domain name registration to PSI-Japan or to a third party on the customer's behalf.
If an expired domain name registration is not renewed as outlined above, absent extenuating circumstances, we will delete the domain name registration. Registry Operators may provide registrars with the ability to “redeem” a deleted domain name registration for a customer, and we, in turn, may (but are not obligated to) provide customers with an ability to redeem a particular domain name registration. Such a Redemption Grace Period (RGP) is not guaranteed and customers should renew their domain name registration services in advance of the domain name registration expiration date(s) to avoid deletion of domain name registration services. Currently, the Registry Operators provide an RGP for 30 days from the date of deletion. If we decide to provide the redemption service to a customer, we charge a fee of 18950 yen to redeem and renew a domain name registration during the RGP. If the domain name registration is not redeemed by the expiration of the RGP, it is then placed on “Pending Delete” status for five additional days, after which it is deleted and the domain name character string is then once again available for registration.
In the event that a domain name registration is the subject of a Uniform Domain Name Dispute Resolution Policy (UDRP) proceeding and expires or is deleted during the course of the dispute, the party that filed the UDRP proceeding has the option to renew or restore the domain name registration under the same commercial terms as the original customer. If the complainant renews or restores his/her domain name, the domain name will be placed on Registrar HOLD or Registrar LOCK status, the WHOIS contact information for the registrant will be removed, and the WHOIS entry will indicate that the domain name is subject to dispute. If the case ultimately is terminated or the arbitrator finds against the filing party, the name will be deleted within 45 days. The registrant can restore his/her domain name anytime during a “grace period” under the agreement concerning a “grace period”. In addition, the registrant can renew his/her domain name before PSI-Japan deletes his/her domain name.
11.Cancelation
In principal, we can't accept a cancelation after providing services.
12. Notification from PSI-Japan, Inc. to Registrant.
All notices between PSI-Japan and its registrants permitted or required under this Policy shall be in writing and shall be delivered by personal delivery, courier delivery, facsimile transmission, and/or by first class mail, and shall be deemed given upon delivery, transmission, or seven (7) calendar days after deposit in the mail, whichever occurs first. Initial notices shall be sent to the domain name registrant at the address of the domain name registrant listed in PSI-Japan's .com, .net, .org WHOIS database or in the .info WHOIS operated by Afilias limited or the .biz WHOIS operated by NeuLevel Inc.
13. Limitation of Liability.
REGISTRANT AGREES THAT PSI-JAPAN WILL NOT BE LIABLE TO REGISTRANT OR ANY OTHER PERSON FOR ANY LOSS THAT MAY OCCUR DUE TO (a) ANY LOSS OF REGISTRATION OF A DOMAIN NAME, (b) THE USE OF REGISTRANT'S DOMAIN NAME, (c) ACCESS DELAYS OR ACCESS INTERRUPTIONS TO PSI-JAPAN'S REGISTRATION SYSTEM; (d) THE NON-DELIVERY OR MISDELIVERY OF DATA BETWEEN REGISTRANT AND PSI-JAPAN ; (e) EVENTS BEYOND PSI-JAPAN'S REASONABLE CONTROL; (f) THE PROCESSING OF THIS APPLICATION; (g) THE PROCESSING OF ANY MODIFICATION TO THE RECORD ASSOCIATED WITH REGISTRANT'S DOMAIN NAME, (h) THE FAILURE OF REGISTRANT OR REGISTRANT'S AGENT TO PAY ANY FEES HEREUNDER; OR (i) THE APPLICATION OF THE UDRP. FURTHER, PSI-JAPAN WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF PSI-JAPAN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL PSI-JAPAN'S MAXIMUM LIABILITY EXCEED THE TOTAL AMOUNT PAID BY REGISTRANT TO PSI-JAPAN FOR REGISTRATION OF REGISTRANT'S DOMAIN NAME DURING THE PRIOR 3 YEARS (In the case of first registration, the amount for the first registration) UNDER THE TERMS OF THIS AGREEMENT.
BECAUSE SOME STATES (AND COUNTRIES) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES (OR COUNTRIES), OUR LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW.
14. Indemnity.
Registrant agrees to defend, indemnify and hold harmless PSI-Japan and any applicable domain name registry, including Network Solutions, Inc., and Verisign Inc., Affilias Limited or NeuLevel Inc. and the directors, officers, employees and agents of each of them, for any loss, damages or costs, including reasonable attorneys' fees, resulting from any third party claim, action, or demand related to Registrant's domain name or the use thereof. This indemnification is in addition to any indemnification required under the UDRP.
15. Governing Law .
This Agreement, Registrant's rights and obligations and all actions contemplated by this Agreement shall be governed by the laws of Japan, as if the Agreement was a contract wholly entered into and wholly performed within Japan. Any action to enforce this Agreement or any matter relating to Registrant's use of the PSI-Japan site shall be brought exclusively in the courts of Japan in the city of Tokyo.
However, in cases of disputes concerning or arising from use of the SLD name, the SLD holder shall submit, without prejudice to other potentially applicable jurisdictions, to the courts (1) of the SLD holder's domicile and (2) the courts of Japan (ICANN Agreement, Section II.J.7.h.)
16. Multilingual Domain Names (IDN)
The conditions applicable to the Application for Registration of Multilingual Domain Names shall be essentially the same as those applicable to the Application for Registration of Regular ASCII Domain Names. However, the Registration of Multilingual Domain Names during the Multilingual Domain Name testbed period shall be solely for the purpose of participation in the testbed, and such domain names will not be operational on the internet before the testbed is completed.
When the testbed is completed and regular registration begins, Multilingual Domain Names will be operational in the same manner as the regular ASCII domain names. However Registrant agrees that the Registry may stop Multilingual Domain Name operations due to technical or other reasons.
In addition, Registrant agrees that the Registry may delete the registered Multilingual Domain Names in cases where letters/characters available at the time of application for Multilingual Domain Name registration become unusable as Multilingual Domain Names due to technical or other reasons, etc. In such cases, the registration fee will be refunded. However, such refund may not be made if the Registry alters relevant terms (e.g. in the case that the new terms require the payment of the registration fee to the Registry).
17. .biz Domain name Agreements
Companies using the Neulevel "IP Claim Service" are required to agree to the terms of that Agreement, Terms of Use
.In cases of conflicts between a .biz domain and an IP Claim, they are to be resolved by the Start-Up Trademark Opposition Policy ("STOP") procedure. If the conflict cannot otherwise be resolved, a Restrictions Dispute Resolution Policy ("RDRP") arbitration may be invoked. Applicants for .biz domains are required to agree to these procedures as a condition precedent to making application.
18. .info Domain name Agreements
Firms with registered trademarks or service marks may register domain names along with information on their registered Marks. These procedures are described in Appendix J of the ICANN/Afilias Agreement.Sunrise registrations are subject to challenge by third parties in accordance with the "Sunrise Dispute Resolution Policy", a part of Appendix J. Lacking a response to a challenge, the disputed domain name will be cancelled and the challenger may be permitted to register the disputed domain.

Registrant of .mobi is required to agree to the terms of agreements for .mobi and to read dotmobi Switch On! Web Developer Guide, the rules for use of .mobi Registrant who uses precedence registration to protect registered trademarks or service marks(Sunrise registration), is obligated to read Sunrise Challenge Policy.

Registrant of .asia is required to read Charter Eligibility Requirement Policy and registrant who uses precedence registration to protect registered trademarks or service marks (Sunrise registration), is obligated.to read Sunrise Policies.
21.tel Domain name Agreements
Registrant of .tel is required to read Requirements for Agreements with Domain Name Holders and registrant who uses precedence registration to protect registered trademarks or service marks (Sunrise registration), is obligated to read Sunrise Policies.
Registrant of .tel is required to read Acceptable Use Policy, the rules for use of .tel
22.jp Domain name Agreements
Registrant of General-use JP domain name is required to agree to the provisions for registration of General-use JP domain name and registrants of Organizational type and Geographic type JP domain names are required to agree to the provisions for registration of Organizational type and Geographic type JP domain names. In addition, all JP domain names registrants agree to the terms of the agreements concerning the information of JP domain name's registration, the agreements concerning disclosing information and JP domain name DRP. In the event that registrant requests to renew the domain name registration, registry provides one year renewal after the day of the expiration date. If the registrant requests to renew for more than one year, the registry provides renewals only for one year at a time. In the case that registrant transfers his/her domain name to other registrar from PSI-Japan ( transfer of registrant including alteration of registrant) before the reflection of renewal, PSI-Japan is not required to refund the amount for the inapplicable terms and not required to renew after that registrant has finished transfer to other registrar.

The registrant is required to agree to the terms of agreement of the registry that the registrant will gain his/her domain name from. In the event that PSI-Japan registers a domain name of registrant through InternetX, registrant is obligated to agree to the registration agreements of InternetX. Registrant agrees that PSI-Japan provides registrant's information of the domain name registration to each registries, InternetX and intermediary company.
24. Whois Proxy service
Registrant, administrative, technical, and billing contacts who use PSI-Japan's whois proxy service are obligated to agree to whois proxy service statement.
25. Privacy Statements
Registrant is obligated to agree to PSI-Japan's privacy statement.
